LONG DESCRIPTION: To provide transparency of its implementation of the requirement to study the system impacts of net-metering arrangements involving new large loads and stand-alone generation resources, as required by Public Utility Regulatory Act (PURA) Section 39.169, ERCOT is including as an attachment to this Market Notice a list identifying each Generation Resource that ERCOT has determined is a "stand-alone generation resource[s] as of September 1, 2025" within the meaning of that provision. Section 39.169 was enacted as part of Texas Senate Bill 6 (89th Texas Legislature, Regular Session), which became effective on June 20, 2025.
As explained in ERCOT's filing with the Public Utility Commission of Texas (PUCT) today in Project Nos. 58317 and 58479, ERCOT has included a Generation Resource in this list if that Resource was (1) included in ERCOT's Network Operations Model as of September 1, 2025 and (2) the modeled generation facility that includes the Resource did not include a modeled Private Use Network (PUN) load as of that date. ERCOT has not included Energy Storage Resources (ESRs) on this list and defers to the PUCT as to whether ESRs should be considered "stand-alone generation resource[s]" for the purposes of PURA Section 39.169.
Any Resource Entity that wishes to initiate an ERCOT system impact study may do so by submitting a completed and executed copy of the attached Notice of Proposed Net Metering Arrangement. This form, and any updated versions thereof, will be posted on the Large Load Integration page of ERCOT's website under "Forms and Other Documents," along with the list of stand-alone generation resources.
Any Resource Entity that wishes to assert either of the exemptions from ERCOT's system impact study described in PURA Section 39.169(b) may assert such an exemption at any time prior to submitting a model change to reflect the Large Load addition by submitting documentation of the grounds for the assertion to MPRegistration@ercot.com along with a notarized attestation from the Authorized Representative (AR), Backup AR, or a company officer attesting to the facts required for the exemption and the accuracy and completeness of the submitted documentation. ERCOT will consult with PUC Staff in reviewing the submission and will notify the Resource Entity whether it agrees that the exemption applies. Any approved exemption under Section 39.169(b)(2) will apply only to the Large Load Customer identified in the submission.
The attached form and the procedures described in this Market Notice are established on an interim basis for the purposes of timely implementing PURA Section 39.169. The form and these procedures are subject to change and may be preempted by the PUCT's forthcoming rules governing the process for studying and reviewing net metering arrangements.
