SHORT DESCRIPTION:  Implementation Details of NPRR1087 and Action required by Resource Entities representing Load Resources

INTENDED AUDIENCE: All Market Participants

DAYS AFFECTED: December 20 and 30, 2021

LONG DESCRIPTION: On December 20, 2021, the remainder of Nodal Protocol Revision Request (NPRR) 1087, Prohibit Participation of Critical Loads as Load Resources or ERS Resources, will be implemented.

On November 30, 2021, the Public Utility Commission of Texas and Railroad Commission of Texas both adopted rules regarding critical load designations of natural gas facilities. The rule amendments (available here and here) will be effective on December 20, 2021.  Pursuant to the Revised Impact Analysis for NPRR 1087, the revisions to Protocol Section 3.14.3.1 and paragraphs (7) and (8) of Protocol Section 3.6.1 made by NPRR1087 become effective upon the effective date of these rule amendments.

Once implemented, paragraph (8) of Protocol Section 3.6.1 will require any Resource Entity that represents a currently registered Load Resource to ensure and attest that the Load Resource is not located behind an Electric Service Identifier (ESI ID) for a Critical Load (as that term is defined in the Protocols), or if it is located behind such an ESI ID, that the Load Resource itself is not the Critical Load or else has available backup generation or another technology that will ensure the Load’s continued availability during an emergency deployment.  If a Resource Entity cannot provide the attestation for any currently registered Load Resource, the Load Resource will not be permitted to submit any offer to provide Ancillary Services.  Any Resource Entity seeking to register a new Load Resource will also be required to submit such an attestation as a condition of registration.   

ACTION REQUIRED:  As required by paragraph (8) of Protocol Section 3.6.1, each Resource Entity that represents an existing Load Resource must complete the required attestation and return it to ERCOT by December 30, 2021. The attestation form should be submitted as a pdf via email to LRAttestation@ercot.com with the subject line “Critical Load Attestation.” The required attestation form is attached to this Notice, and the form can also be found on the ERCOT Load Resource webpage under Key Documents.

ADDITIONAL INFORMATION: Pursuant to Nodal Protocol Section 21.6, Nodal Protocol Revision Implementation, ERCOT is required to provide notice as soon as practicable, but no later than ten days prior to implementation.
