LONG DESCRIPTION: On July 16, 2021, Electric Reliability Council of Texas, Inc. (ERCOT) filed with the Public Utility Commission of Texas (PUC) an application for a debt obligation order to finance the Uplift Balance, as that term is defined in Subchapter N of Chapter 39 of the Public Utility Regulatory Act (PURA).  ERCOT’s request for approval of a debt financing mechanism to finance the Uplift Balance is intended to mitigate the effect of Winter Storm Uri on load serving entities (LSEs) within the ERCOT power region. For additional information please see Market Notice W-B071921-01 and PUC Docket No. 52322, Application of ERCOT for a Debt Obligation Order to Finance Balances Under PURA Chapter 39, Subchapter N, for an Order Initiating a Parallel Docket, and for a Good Cause Exception.

On July 27, 2021, PUC staff filed a request for a parallel proceeding for eligible entities to opt out of such uplift charges, and for LSEs to provide documentation of exposure to costs pursuant to the Debt Obligation Order that will be issued in PUC Docket No. 52322. See PUC Docket No. 52322-46, Commission Staff's Recommendation on Sufficiency of the Application and Notice, Request for Good Cause Exception, and Request for Parallel Proceeding.

On July 29, 2021, PUC staff initiated PUC Docket No. 52634, Proceeding for Eligible Entities to File an Opt Out Pursuant to PURA § 39.653(d) and for Load-Serving Entities to File Documentation of Exposure to Costs Pursuant to the Debt Obligation Order in Docket No. 52322.

PUC staff has requested that ERCOT issue a Market Notice informing Market Participants of PUC Docket No. 52634. Interested Market Participants should track the proceedings in both PUC dockets (52322 and 52634) to remain apprised of information concerning the process for LSEs to provide documentation of exposure to costs, opt out eligibility, and the process for opting out.
