SHORT DESCRIPTION: In response to a public information request, ERCOT has posted on its website the short-pay amounts relating to Winter Storm Uri that are owed to all Qualified Scheduling Entities (QSEs) and CRR Account Holders (CRRAHs).

LONG DESCRIPTION: ERCOT received an information request from Citigroup Global Markets (Citigroup) seeking the short-pay amounts owed to all QSEs and CRRAHs relating to Winter Storm Uri.  In response, ERCOT has prepared a spreadsheet listing the name of each QSE and CRRAH owed such short-pay amounts and identifying the total short-pay amount owed to each entity, as of the date of this Notice, for invoices that cover Operating Days that are more than 180 days old.  The Citigroup information request, along with the responsive spreadsheet, is now posted on ERCOT’s website at: https://www.ercot.com/about/contact/inforequest/previnfo.

The short-pay amounts reflected in the spreadsheet also include balances associated with short-payments of Congestion Revenue Right (CRR) Auction Revenue Distribution (CARD) Settlement Invoices.  The amounts in the spreadsheet further account for the funds that were disbursed in November 2021 to Counter-Parties pursuant to Texas Utilities Code, Chapter 39, Subchapter M.  The short-pay amounts reflected in the spreadsheet will continue to change as additional funds are received and disbursed over time.

In some cases, the spreadsheet will show short-paid balances due to QSEs and CRRAHs belonging to Counter-Parties (e.g., Brazos Electric Power Cooperative, Inc. and Rayburn Country Electric Cooperative, Inc.) that also have balances owing to ERCOT.  This arises because these Counter-Parties were owed funds from ERCOT on days when it was necessary for ERCOT to short-pay the Market.  ERCOT will not reimburse the short-pay amounts owed to these Counter-Parties until their outstanding obligations to ERCOT are paid in full.

ERCOT has not identified any provision in the Protocols that would classify the short-pay information as Protected Information.  Further, settlement information is generally publicly available 180 days after the applicable Operating Day and the short-pay amounts reflected in the spreadsheet arise from invoices covering Operating Days that are more than 180 days old.  See, e.g., ERCOT Protocols, Section 1.3.1.1(1)(j) (Protected Information status of Settlement Statements and Invoices identifiable to a specific QSE expires 180 days after the applicable Operating Day).  The total aggregate short-pay amount owed to all parties relating to Winter Storm Uri has been published by ERCOT in previous Market Notices.
