SHORT DESCRIPTION: End of TCEQ Enforcement Discretion for Certain Generation Resources That May Be Needed to Resolve Transmission Congestion in South Texas

LONG DESCRIPTION: On March 29, 2024, ERCOT issued a Market Notice indicating that the Texas Commission on Environmental Quality (TCEQ) had notified ERCOT of its intention to exercise enforcement discretion with respect to potential violations of certain air permit requirements associated with South Texas Electric Cooperative, Inc.’s (STEC) operation of the Generation Resources at the Red Gate Power Plant (namely, REDGATE_AGR_A, REDGATE_AGR_B, REDGATE_AGR_C, and REDGATE_AGR_D, hereinafter referred to as the “Red Gate Units”). Under the terms of TCEQ’s letter providing enforcement discretion, the Red Gate Units would be allowed to operate only if they were needed to address certain ERCOT-declared transmission emergencies impacting South Texas.
As described in TCEQ’s letter, TCEQ’s enforcement discretion would be in effect until the effective date of an agreed order in Docket No. 2024-0430-AIR-E. ERCOT has been notified today that the agreed order has become effective. Consequently, TCEQ’s enforcement discretion has ended, and ERCOT understands that STEC is now permitted to resume normal operation of the Red Gate Units.
