SHORT DESCRIPTION: Confirm Market Participants' Affiliates and Lone Star Infrastructure Protection Act (LSIPA) Attestation by January 30, 2026, for LSIPA Compliance Purposes

INTENDED AUDIENCE: All Market Participants

LONG DESCRIPTION: ERCOT Protocols Section 16 requires that all Market Participants must provide ERCOT with a list of its Affiliates and timely update ERCOT on any change to its listed Affiliates by filing a Notice of Change of Affiliates.

All Market Participants must also confirm whether one or more of its Affiliates is owned or controlled by a citizen of an LSIPA Designated Country or an LSIPA Designated Company, as reflected in Section 23, Form Q: Attestation Regarding Market Participant Citizenship, Ownership or Headquarters (LSIPA Attestation). See ERCOT Protocols  16.1.3. If there are changes to a Market Participant's Affiliates such that the Market Participant has an LSIPA Affiliate that has not been previously reported, the Market Participant must execute and submit a new LSIPA Attestation to ERCOT. See ERCOT Protocols 16.1.3.(4).  

ERCOT is sending this Market Notice to remind Market Participants of their on-going obligations to update their lists of Affiliates and LSIPA Attestation. It is imperative that ERCOT have access to current and accurate Market Participant information for the purpose of ensuring LSIPA compliance.

By January 30, 2026, ERCOT encourages all Market Participants to review their current list of Affiliates and LSIPA Attestation provided to ERCOT and, if needed, submit an updated Notice of Change of Affiliates and/or an updated LSIPA Attestation via email to MPRegistration@ercot.com.

Beginning February 2026, ERCOT will implement a more rigorous, randomized auditing of Market Participants' documentation (i.e., Affiliate lists and LSIPA Attestations) to determine whether a Market Participant has accurately identified its Affiliates for LSIPA compliance purposes. If noncompliant with the Affiliate LSIPA requirements, ERCOT may refer the Market Participant to the Public Utility Commission of Texas' Division of Compliance and Enforcement, and the Market Participant may be subject to administrative penalties up to $1 million for each violation. See Tex. Bus. & Com. Code 117.004.

ACTION REQUIRED: By January 30, 2026, all Market Participants should: 1) review their current list of Affiliates and their LSIPA Attestation provided to ERCOT; and 2) if needed, submit an updated Notice of Change of Affiliates and/or an updated LSIPA Attestation.
