SHORT DESCRIPTION: Notice of Disclosure of Protected Information and ERCOT Critical Energy Infrastructure Information

DAYS AFFECTED: October 22, 2025, and ongoing

LONG DESCRIPTION: The Office of the Attorney General of Texas (OAG) served Electric Reliability Council of Texas, Inc. (ERCOT) with a Civil Investigation Demand (CID) in connection with an ongoing OAG investigation.  The CID seeks ERCOT market and operations data that includes Protected Information and ERCOT Critical Energy Infrastructure Information (ECEII) necessary for the OAG to evaluate potential violations of applicable law.  

In accordance with Section 1.3.5 of the ERCOT Protocols, Notice Before Permitted Disclosure, ERCOT hereby provides notice that it will immediately disclose the information requested to the OAG as required by applicable law.  To fulfill ERCOT's obligation under Section 1.3.5(1) to take steps to maintain confidentiality, ERCOT will ensure confidential information is labeled as such and rely on the statutory information protection requirements applicable to information responsive to the CID.
