SHORT DESCRIPTION: Update to Transmission- Voltage Customers Opt- Out List Maintained Pursuant to PURA section 39.653(d)

LONG DESCRIPTION:   Under the Public Utility Commission of Texas's (PUCT) Debt Obligation Order in Docket No. 52322, issued October 13, 2021 (the Subchapter N Order), ERCOT was authorized to issue securitization bonds under Public Utility Regulatory Act (PURA) chapter 39, subchapter N, in an amount up to $2.1 billion. The Subchapter N Order also, among other things, created a process that enabled transmission-voltage customers (TVCs) who had paid all of their invoices incurred during Winter Storm Uri to opt out of securitization uplift charges under PURA section 39.653(d). A current list of TVCs who have opted out of securitization uplift charges is maintained on ERCOT's Subchapter N Uplift Balance Securitization webpage under the "ERCOT Protocols and NPRRs" heading.  

On August 29, 2024, the PUCT issued a Declaratory Order in Docket No. 56125 clarifying, among other things, that a TVC opt-out under PURA section 39.653(d) and the Subchapter N Order is not transferable to other entities. On August 20, 2025, PUCT Staff filed a petition in Docket No. 58531 seeking to update the TVC opt-out list. Specifically, in that petition, PUCT Staff sought the removal of 18 ESI IDs from the opt-out list. 

On July 30, 2026, the PUCT issued an Order in Docket No. 58531 directing ERCOT to remove the following 15 ESI IDs from the current TVC opt-out list:

That Order directed ERCOT to select an effective date for the removal of the above ESI IDs at least seven and no more than 21 days after the date of the Order.  ERCOT has accordingly designated an effective date of August 17, 2026 for the removal of the above 15 ESI IDs from the current TVC opt-out list.  

Under the Order, ERCOT must issue a Market Notice to the Retail Market Subcommittee (RMS) indicating that the above-listed 15 ESI IDs will be removed from the opt-out list along with the effective date of the removal.  This Market Notice, which will be sent to the RMS e-mail listserv, serves as notice that, effective August 17, 2026, the above 15 ESI IDs will be removed from the TVC opt-out list maintained by ERCOT.
