SHORT DESCRIPTION: TCEQ Enforcement Discretion Beginning at 12 p.m. (Noon) on January 23, 2026 and Ending at 12 p.m. (Noon) on January 27, 2026
INTENDED AUDIENCE: QSEs and Resource Entities with Generation Assets and Customers with On-Site Backup Generation

LONG DESCRIPTION: ERCOT anticipates a significant risk of an Emergency Condition for the period beginning at 12 p.m. (noon) on January 23, 2026 through 12 p.m. (noon) on January 27, 2026 due to severe winter weather impacting the ERCOT Region. ERCOT has notified the Texas Commission on Environmental Quality (TCEQ) that this condition requires the use of all available generation during this period, including any additional generation that may be subject to emissions limits or other restrictions subject to enforcement by the TCEQ. ERCOT has therefore requested that the TCEQ exercise its enforcement discretion with respect to any generator exceedances of these operating restrictions that may occur during this period.
In accordance with Texas Health and Safety Code section 382.086(b)(1), ERCOT hereby provides notice to Market Participants that TCEQ has confirmed that enforcement discretion is available with respect to any violation of any rule or standard subject to TCEQ enforcement, including an emissions limit or standard, hours of operation limit, or any similar operational limit, by an owner or operator of an electric generation facility or on-site backup generation facility operating in the ERCOT Region, if such violation occurs during the following period:
12 p.m. (noon) on January 23, 2026 through 12 p.m. (noon) on January 27, 2026
Any owner or operator of an electric generating facility or on-site backup generation facility that violates any rule or standard subject to TCEQ enforcement due to operation during this period must comply with the restrictions and reporting requirements of Texas Health and Safety Code section 382.086(c) and report any emissions exceedances to the TCEQ in accordance with TCEQ regulations and permit requirements, as required by Texas Health and Safety Code section 382.086(e). Entities may comply with the reporting requirements of Texas Health and Safety Code section 382.086(c) by sending the required information to ocerequest@tceq.texas.gov.
